1. Agreement to Terms

By accessing or using PlotDetect services provided by PlotDetect Pty Ltd (ABN pending), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

PlotDetect provides property compliance research tools including MapViewer, ChartViewer, and Compliance Engine. These tools aggregate publicly available planning data from NSW government sources.

3. Data Accuracy and Provenance

PlotDetect aggregates data from NSW Planning Portal, NSW Spatial Services, Valuer General NSW, council DCPs, and LEPs. While we strive for accuracy, data may be outdated, incomplete, or contain errors. Data currency dates are disclosed for each council. See our Data Methodology for details on how data is extracted and maintained.

PlotDetect is not a substitute for professional planning advice. Always verify information against original source documents and consult qualified professionals before making planning or development decisions.

4. AI and Technology

PlotDetect uses deterministic database lookups to return planning provisions. It does not use generative AI, large language models, or machine learning to produce or modify the planning data returned to users. See our AI Disclaimer for a full explanation of our technology approach.

PlotDetect does not interpret provisions, assess compliance of specific proposals, or provide planning recommendations. Outputs are informational only and require professional assessment.

5. API Access

API access is provided under licence. API users agree to:

• Use API keys only for their authorised purposes
• Not share API keys with unauthorised parties
• Respect rate limits and usage quotas
• Not cache or redistribute PlotDetect data beyond the scope of their licence
• Include appropriate attribution when displaying PlotDetect data to end users

6. User Accounts

Some features require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

7. Acceptable Use

You agree not to:

• Use automated tools to scrape or bulk download data
• Attempt to circumvent access controls or security measures
• Redistribute PlotDetect data commercially without permission
• Use the service for any unlawful purpose

8. Intellectual Property

PlotDetect owns the software, design, and presentation of our services. Underlying planning data is sourced from NSW government agencies and councils under their respective terms.

9. Limitation of Liability

To the maximum extent permitted by Australian law, PlotDetect Pty Ltd is not liable for any indirect, incidental, special, or consequential damages arising from your use of PlotDetect services.

Our liability for direct damages is limited to the fees paid by you in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access at any time for violation of these terms. You may cancel your account at any time by contacting us.

11. Changes to Terms

We may update these terms from time to time. Continued use after changes constitutes acceptance. Material changes will be notified via email or website notice.

12. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
